The ICC Review Conference in Kampala last month reached the historic agreement to include the crime of agression under the jurisdiction of the International Criminal Court. However, the United States successfully maneuvred to subvert the process. By obtaining ICC subordination to the decisions of the Security Council where the U.S. wields veto power, Washington has not only further eviscerated the Court, it has in effect guaranteed immunity for U.S. nationals who are guilty of crimes also under this new category. The cases filing before the Court will therefore continue to be mostly criminals from Third World countries designated by Western powers.
